New A2 (to me)

Hi to everyone,

I took delivery of my A2 on Wednesday of this week, after owning it for just 2 days I asked my local garage to check it over, as I expected with 17 year old car to at least need a few odd consumer bits, brake pads, light bulbs etc. Well within 15 minutes I get a phone call informing me that the engine was blown!
You can't imagine how deflated I felt, the car had been delivered from the Trader I bought it from in Blackburn to my home in Lincolnshire. It had 94,000 miles a full service history a current Mot and appearance wise, tidy bodywork, really clean interior, reasonably good tyres and so on.
Over the two days I'd driven all of 20miles with no real issues, yes the brake pad warning light came on a couple of times and it ran a little erratic on tick-over, but nothing that gave me cause for undue concern.
I hold my hand up that I bought it unseen, this is due to the inability to leave my home at the moment due to the circumstance that we all find ourselves in.
Sorry to ramble on, but my question is a 'blown engine' for this to happen should there have at least been some form of warning, overheating, poor running, warning lights? As you can probably tell I'm quite mechanically inept.
I'm now faced with either a struggle with the Trader I bought the car from (his first reaction to the news was "it was okay when it left me") or find a solution to the problem.
Has any A2 owner had to deal with a blown engine?
Is it possible or economical to repair, rebuild or replace an engine?
Any comments or advice would be most helpful.....
Thanks

Sorry to hear that, what did the garage say specifically had ‘blown’ I note from your signature it’s a 1.6 FSI.
I think you should be able to return to the dealer for a refund.

Anyone?

Hello, welcome to the forum, it’s a shame it’s not under better circumstances

Was ‘blown engine’ the exact terminology used by the garage you took it to?

You need to know from the garage what exactly they think the fault is.

Yes 'blown' was the word used. I hasten to add that the garage is preparing a documented report on what they discovered, which hopefully will be more detailed.

I agree, I'm attempting to find a company that will transport the vehicle from my home to Blackburn.
It's proving quite hard to get any sensible response from the trader, his attitude is "there was nothing wrong with the car when it left here" and I'm struggling to get him to accept having the car back so that he can do his own inspection.
I didn't pay top price for the car and maybe it will come down to "BUYER BEWARE". I hope a solution can be found....

Im sure that you should be able to return for refund or depending on what’s actually wrong financial recompense to correct!

This may help https://www.moneyadviceservice.org.uk/en/articles/your-rights-if-something-is-wrong-with-your-car

Hope the dealer works with you on the problem!

Found this useful tool from the CAB in the article I referenced above for anyone who may have a problem with a used car, in this instance it seems you should be entitled to a refund.

Thank you for your helpful comments.
I'll firstly give the trader every opportunity to take the car back, but if all else fails then the links will prove invaluable.
But, and I know it may sound daft but I really want this car, (well maybe not this exact one).

Thank you all for your comments, regarding the sellers responsibility to take the car back, but unfortunately no one has told him!
Over the last few weeks I've had abusive replies to my telephone calls even slamming the phone down on me, the car trader flatly refuses to accept the return of the car.
I've now had to take legal advice and started a course of recorded letters informing him of my right to reject the car under the Consumers Rights Act 2015, but to no avail he's just totally ignoring his legal obligations.
It doesn't help when Blackburn and Darwen Trading Standards Office won't even reply to my request for their assistance.
If the authorities won't act when there is blatant abuse of consumers rights then Car Traders of this ilk, will take every advantage of the current situation we all find ourselves in.
I only wish I could name and shame him, but I've been advised not to as this may any effect any future legal action.
All I would say is that to check any car that is being offered for sale as thoroughly as possible and if in any doubt walk away.
I don't wish my circumstances on anyone.

Any chance that a member around Blackburn could check that he actually is a Bona Fide Trader (not just flogging cars off his drive)? If he's not, then you're wasting money on the legal route, as there's no asset to claim against.
How did you pay him? CC or Bank Transfer? To a company account, or his personal account?
Since you may end up with the car, what does the garage say is actually wrong with it? Did it run when it came off the flatbed?
Mac.

Hi Mac,
This guy is still trading, although now it looks like it's only through an auction site.
He's registered as a business seller with them and is currently advertising cars for sale, on their site.
He's an active director of another company that's also listed at the same address.
I can't go into the details of where I'm currently at, but suffice to say that an awful lot of information has been discovered about this trader.
To answer your questions regarding the condition of the car:
The car has subsequently undergone a full and detailed inspection by a Professional Vehicle Inspection Company. It was found to have numerous faults some so serious that the engineer would not road test the car as he deemed it be unroadworthy.
It does start and drive, but it is not advisable as after only a short distance the car bellows out smoke from the exhaust.
The engineer's summary, and without going into chapter and verse, stated that the nature of the faults found during his inspection concluded that the faults were pre-existing or ingrained into the vehicle at the time of purchase.
Even with this evidence I've still been subject to his refusal to abide by his legal obligations, but with no one willing to enforce the law he seems to able to conduct his business any way he choses.
Michael

Thanks for the reply. It's very frustrating that when push comes to shove, all the political (local and national) talk about consumer rights comes to nought.
Fingers crossed that you get a satisfactory resolution.
I'd write to
Corporate Complaints Manager,Blackburn with Darwen Borough Council,Town Hall,King William Street,BB1 7DY
Including a copy, or link to this thread, which reflects badly on their TS Dept.
There's more details on how to complain at:
Mac.

Thanks for the info, Mac
I'll look into making a formal complaint to the link, and keep my fingers crossed for at least an acknowledgement.

Anyone on here live in the Blackburn and Darwen bailiwick? If so, can they provide local district Councillor's contact details? Then that member (as a voter) could send them a link, for their comments perhaps. Come on, A2 Forum Power to the people!
Mac.

Have a nice long chat with a local newspaper and give the trader a bit of free advertising. Even better if you have written and verbal evidence.
