gearbox bearing?

I've got an A2, 1.4 basic manual petrol from 2002 - bought it second hand in September, from a Toyota dealer in north London.
Straightaway it started making a whirring noise from down below the passenger footwell (imagine a cat purring very loudly). It's a noise that comes in when it's warmed up and then makes it at almost any speed above the slowest speed.
Took it back to Toyota (who sold me the car with an Aon warranty) and they took it to Audi who said it was a gearbox bearing. Sound familiar? The car had 40,000 miles (allegedly) when I bought it.

Furthermore, if Aon feel the problem happened under my watch, then they are saying they won't cover it. Of course, to get to the problem takes £1100 worth of labour in the first place, and only then do they decide if they will proceed, potentially leaving me with a bill of £1100.
Is this standard practice with warranties? with Aon?

Any thoughts?
